Both ride-sharing companies are publicly traded with revenues that exceed the multi-billion-dollar level. Being such large businesses, they have substantial insurance policies to cover them and their drivers in the event of an accident. Did you know that Uber drivers may have more than one million dollars in coverage?
Another little-known fact is that there may be additional excessive coverage available if the driver is found at fault for the accident. Most people are shocked to learn that the average driver in the state of California only carries around $15,000 in injury liability.
When someone chooses to drive for a ride-share company, these freelancers may be more covered in an accident than a regular private driver. However, the coverage depends heavily on the driver’s status at the time of the crash.
In general, there are three liability limits which a Lyft or Uber driver may have depending on whether the driver was not logged into the app, was logged in and waiting for a passenger, or had already matched with or picked up a passenger.
Uber and Lyft only provide full coverage during certain ride-share periods. The Uber or Lyft driver is responsible for purchasing their own insurance policy for times when they are driving the car in a normal manner and are not using the app for ride-sharing purposes.
No Period means the driver is currently offline from the app and is not using it for ride-sharing purposes. Any claims arising out of an accident during this time will usually be the driver’s responsibility.
Period 1 means the driver is logged into the app and waiting for a passenger to match with. Uber and Lyft may have 50/100/25 liability coverage in the event of an accident during this time.
This means that the liability limitations for bodily harm may be $50,000 per person and $100,000 total per accident, with $25,000 for property damage. Furthermore, insurance coverage for the driver, including uninsured, underinsured, medical expenses, and collision coverage for the driver’s vehicle, may not be available during this time.
Period 2 begins when the Uber or Lyft driver has accepted a fare on the app and is on the way to pick up a passenger. During this period, an Uber or Lyft driver or passenger who sustains injuries in a non-fault car accident may have up to $1 million in liability coverage.
There may also be uninsured and underinsured coverage under the ride-share company’s policy, along with additional coverage under certain contingent excess insurance policies. An experienced Uber accident attorney can help you decide whether you have sufficient compensation and coverage for your medical expenses.
Period 3 begins when the Uber or Lyft driver has picked up the passenger and is en route to the passenger’s destination. Both companies may offer $1 million in liability, uninsured, and underinsured coverage during this period.
This is also the period where additional excess policies may apply. Collision coverage may depend on whether the driver already has collision coverage as part of their personal insurance policy.
